True face of "Holy Than Thou CVC & CBI".

In this article we are now going to show some true facts as to how "Holy" the govt bodies CBI & CVC are. Indian public always knew about CBI, infact even the apex court has now passed judgment on their role. Here we'll take one particular issue to show all how unethically they work, with solid proofs obtained through RTIs and contacts in Coal India.


Last one year IIT Kharagpur was without any proper head, even though Director got selected. Prof P P Chakrabarti got selected but his appointment got embroiled in "Self-Created" controversy by CVC. Now let us show you the TRUE facts behind the whole controversy. Many a time’s people told us about CVC being corrupt. But we decided not to believe them. But now we feel differently and feel Indian public need to see "How an Innocent Prof gets Harassed by CVC". (Clicking the images would give enlarged view)

Coal Net project was collaboration between IIT Kharagpur and Coal India (CIL) to develop software for CIL. For this IIT Kharagpur took manpower help from another company TCG. Presumably, on a complaint from Coal India, CBI investigated and asked for major penalty against two professors while minor penalty against Prof P P Chakrabarti (PPC). Charges against PPC being - "Misrepresenting" IITs stand to Coal India. Let us show you the entire letter which was construed as "PPC misrepresenting" to CIL. You all can decide yourself the truth behind the charge made against him.

Going through the letter only one question comes to the mind, “What exactly is he MISREPRESENTING”? He seems to be giving all the facts truthfully, clearly and transparently that man-power help was taken from TCG. How come CBI call this misrepresentation and later same is charged by even CVC???

Is telling the truth supposed to be Fault as per CBI & CVC!!!


Now let us go through few more documents, they'll put few more holes into this whole so called "Investigation against Corruption".

Doc -2 : Prof Acharya et all application to Dean SRIC Prof Bhowmick

The application above shows Prof Acharya asking then Dean SRIC to approve man-power help from TCG. Point to be noted here: They clearly talk about "Man Power" approval and not total outsourcing of the project as being claimed by CBI, Coal India, CVC and also our dear media.

But question that arises:

1. How come Prof Acharya never got named in the CBI report???

2. How come CVC gave clearances to Prof Acharya for different administrative posts???

Now for the third document (Posted below, Doc 3) which next shows that it was NOT Prof Bhowmick who gave the approval for TCG man-power. He in turn got it from the then Director.


And crux of the matter being there's nothing wrong in getting man-power help from outside source. There has been much precedence in different IITs where manpower help was taken from other private companies. CVC conveniently finds no fault in the same!!! Now check the document below.

Now coming to the MOST interesting part of this whole issue. IIT Kharagpur actually is NOT at fault for anything. See the document below!




Doc - 4 : Document relating to a meeting between IIT Kharagpur and Coal India

This document shows a meeting being arranged between Coal India and IIT Kharagpur by Prof R N Bannerjee. Do look through the names who were CCed in the letter. The named marked by a tick, #6, Mr S K De, he is from TCG. 

The letter is dated 25th June 2001, clearly proved one fact - Coal India was very much AWARE OF TCG BEING PART OF THIS PROJECT!!!

In that case how come Coal India complains about the issue???

But more importantly, How come CBI & CVC suddenly find all fault with IIT Kharagpur and not CIL?? Isn't making false charges a penalty in itself? 

So what kind of investigation was this??? The main people involved here, like Prof Acharya, never got implicated but the one person, who had NOTHING to do with the project, gets implicated and face the harshest of all punishment. Was this done in error or deliberately??


And now coming to the covering letter of the CBI report.

Doc - 5 : CBI report covering letter.

Check #3 point made by them. They clearly say THIS REPORT WON'T BE CITED AND RELIED UPON DOCUMENT IN ANY Departmental inquiries!!! Wow!! And CVC made sure to make one of the biggest "false issues" against an innocent man relying upon such an investigating document. That's how Vigilance Department works in Our Dear Country India!!!

Here's more info that happened these past few months, which raises lot of questions if the issue was created deliberately. We'll put them all point-wise and leave you all to come to your conclusions.


Each event with regards to CVC is being presented chronologically below:

  1. July 2012 PPC got selected as Director IIT Kharagpur. CVC refuses to give clearance and asks for investigation. IIT Kharagpur and many top officials from MHRD tried hard to tell CVC that this is an urgent matter and need to be resolved soon. Instead of working on Director Clearance issue, the investigating Vigilance officer sent in all SIX letters to IIT Kharagpur. None of them discussed anything about the Director Clearance issue. Each of them was related to Prof Rajeev Kumar and what does IIT plan to do about his case of suspension. (Click here to know more about Rajeev Kumar). We have them all with us now as proof.

  2. Govt rule says within three months period, investigating officer if don't sent in any report, the clearance is to be taken automatically. CVC made sure to send a small inquiry just before this three month tenure ended. But at the end of the next three months’ nothing was done. One top officer from MHRD was on way to see how this can be resolved. This happened on 25th Feb, 2013. On 27th Feb, 2013 suddenly media reports that CVC has informed IIT Kharagpur its inability to give PPC clearance and that he deserves to be penalised. Interestingly, when media asked IIT Kharagpur, they had no knowledge as they never received any such letter from CVC!!! First week of March around 2-3 March this letter reached IIT Kharagpur which was Dated 19th Feb, 2013. We leave it upon readers to come to conclusion if this letter was back dated or in fact actually written on 19th. And if latter being the case, question then arises how come it took so many days to reach its destination when all other letters from Vigilance seem to be reaching IIT Kharagpur within a span of 2-3 days?? Also, how come selective media person got to know about this letter so early??

  3. Prof Chakraborty was asked to reply to questions prepared by the investigating officer after the March letter and he submitted his defense by March end. Though readers must know that he had already replied to the same questions earlier four years back and the same defense was again presented. BOG after going through his replies cleared him and the resolution with PPC’s defense was sent to Vigilance & MHRD. Vigilance sat upon it for days. 30th April, 2013 IIT Kharagpur decides to revoke Prof Rajeev Kumar's suspension order subjected to disciplinary action after next BOG meeting. And very next day Vigilance officer investigating the issue gives a clearance to Prof Chakraborty. Is that a sweet co-incidence or was there some sort of deal made, we leave it upon readers to decide!!

  4. But Prof Chakraborty's ordeal does not end here. The next senior Vigilance officer sat upon the file for more than three months. CVC by doing this broke their service rule. It was only after alumni, faculty and students started a nationwide protest, added to it was an ultimatum from MHRD, and they decided to give him the clearance. Can any CVC officer explain what action was taken against this particular Vigilance officer who broke the rule? CVC seem to be on toe when it comes to taking action against others, how about cleaning your own home!! And what is important for all to know here is the fact that “This particular Vigilance Officer (even the earlier one investigating the case) has close contacts with Prof Rajeev Kumar, and even with few office bearers of Aam Aadmi Party who are friends of Rajeev Kumar.”

Now that events are explained, we have few questions for CVC with regards to Harassment of an innocent academician. 


1. The first question being, queries were made four years back to Prof Chakrabarti by BOG to which he gave defense and was cleared.  He gave the same defense again to CVC for the same queries. CVC had with them previous inquiry documents. How come for the same answers they first refuse clearance and later for the same explanations, CVC feels he is innocent and clears him of all charges??? Isn't that IRONICAL & ATROCIOUS!!!

2. CVC seems to depend upon a report by CBI which they themselves have asked NOT TO BE RELIED UPON!!! (Doc - 5) Isn't that height of ridiculous action on part of CVC??? Or was it a deliberate vindictive action?

3. How come CVC don’t find anything wrong in giving clearance to IIT Kanpur Dy Registrar Mr C P Singh when criminal case is still pending in Supreme Court against him? (Case No 2828/2011)

4. How come Vigilance keeps quiet about appointments at IIT Madras, especially K Panchalan as registrar even though they did not meet the eligibility criteria?? When it came to Dr Ghoshal of IIT Kharagpur, CVC feels he does not have the required 55% in his PG so he should be removed from the position. But same was with K Panchalan and his appointment was fine with CVC when the then IIT Director of Madras explained - "He does not have the required 55% in PG but had done PhD so the requirement do not count anymore once you get a higher degree".

5. How does CVC explain giving clearance to IIT Patna Director who was named for major penalty in the same CIL case and in case of Prof Chakraborty who had minor penalty (though all documents showed he was clean), his clearance was kept under wrap for full one year.

6. When they did such an in-depth investigation, how come they never saw Prof Damodar Acharya to be part of the main team working in the project, who even received financial benefits? They conveniently gave him clearance for becoming the member of RBI governor, HOW?? By the way, there's also a CBI case pending against Prof Acharya with regards to running a fake institute inside IIT Campus, CVC doesn’t find that to be of any importance to investigate. Prof Rajeev Kumar has said openly in many forums’ of carrying a personal grudge against Prof PPC, does that have any bearing over the entire ordeal that Prof PPC faced with CVC, more as the officers who handled the file, both are Prof Rajeev Kumar’s friend? We leave it upon our readers to decide!!!

CONCLUSIONS:


It is evident clearly that CVC has different parameters for penalty with regards to investigating cases. In a same case one with major penalty can get clearance easily, one who is involved throughout the issue NEVER gets named/charged yet THE one person who is innocent, face the wrath and ordeal. Prof PPC faced the most unfair ordeal. And why, cause he told the truth, that's the biggest irony of the whole case. Prof Acharya who was working full time with the project, even got financial benefits, never got charged. He enjoyed every administrative position, let alone faces any penalty.

And when we go through few other issues with regards to CVC against IIT Kharagpur (they all are complaints made by Rajeev Kumar to CVC), we find similar cases happening at other IITs and Govt institutions but CVC found it comfortable to ignore those. Best example being the case of IIT Kharagpur Registrar case. Why is CVC targeting IIT Kharagpur in particular?

Moreover, CVC is the worse ones when it comes to replying to RTIs. Either they never reply or if occasionally they do so, they come up with some reason why they are unable to give us the document. RTIs made by us asking for data on few particular clearance issues given in the past by them were replied with a message that they don’t keep record for the same. If this is not an Atrocious reply what would be no idea!!!

BTW each and every alumnus who got such replies or false info can now complain against CVC to CIC asking for action.

Matter of worry is the manner in which a constitutional body is running. Being independent and without any control, they can cause lot of harm if they want to as was done in the case of Prof PPC. We feel Prof PPC/IIT admins should slap a case/PIL against CVC for causing immense harassment, for being unfair and cause damage to his reputation and even of IIT Kharagpur.

People like Kejriwal and his party members are always singing serenades of how great constitutional bodies can be. CVC and this particular case is a blatant example of how even such bodies can be run with malicious intentions. (Interesting to note, we found that too many Aam Aadmi Party members are hand in glove with these vigilance officers and Rajeev Kumar). Mr Kejriwal, do catch up with Ashok Khemka and get more details about Prof Chakrabarti, you'll get to know the truth behind this particular case, about THE Man everyone refer to as PPC and also Rajeev Kumar. Stop talking big about fight against corruption when your own party office bearers indulge into such corrupt practice and be part of harassing an innocent man.

Today we get to see likes of Durga Shakti and Ashok Khemka in bureaucracy facing flak for being honest. Any intelligent person would know its people in bureaucracy itself who are also behind what they face; politicians cannot do anything on their own unless babus agree to follow. Not that our bureaucracy do not have honest officers. But when you see ones in depts like CVC behaving thus, it’s worrying! It is a clear indication that number of honest officers is decreasing and the day dishonest ones grow more in number than the honest ones, whole system would collapse!!! Even Lok Pal cannot help in such a scenario; can it be ensured that even that body would have all the honest ones??? Where to find them, already honest ones seem to be a rare species.

Signing off, hoping, that this immoral system of our country changes for the better soon. Else many more honest men would face unfair treatment just as Prof P P Chakrabarti faced.
